Popapp – Terms and Conditions

Welcome to Popapp! These Terms and Conditions (“Terms”) govern your use of the Popapp mobile application, website, and related services (“Service”), operated by [Your Company Name], a company registered in South Africa. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.


1. Eligibility

1.1 You must be at least 13 years old to use Popapp.
1.2 If you are under 18, you may use the Service only under the supervision of a parent or legal guardian who agrees to these Terms.


2. Account Registration

2.1 To access certain features, you must register an account using a valid email address or mobile number.
2.2 You are responsible for maintaining the confidentiality of your account credentials and all activity under your account.
2.3 You agree to provide accurate, current, and complete information during registration and to update it as necessary.


3. Use of the Service

3.1 You may use Popapp for personal, non-commercial purposes, including discovering events, buying tickets, and interacting with other users.
3.2 You agree not to:

  • Violate any South African laws or regulations.

  • Impersonate another person or entity.

  • Interfere with or disrupt the Service or servers.

  • Use automated systems to scrape or collect data from Popapp.
    3.3 We may suspend or terminate your account if you violate these Terms.


4. Event Listings & Tickets

4.1 Event organizers listed on Popapp are responsible for event details, pricing, and ticketing. Popapp is a platform facilitator and is not the event provider.
4.2 All ticket purchases are subject to the organizer’s terms, and you agree to comply with them.
4.3 Popapp is not responsible for refunds or cancellations; these are governed by the event organizer’s policy.


5. Payments

5.1 Popapp may allow users to purchase tickets or make in-app payments.
5.2 All payments are processed through secure third-party payment providers.
5.3 You agree to pay all fees and charges associated with your purchases.
5.4 Popapp is not responsible for banking errors, payment processing issues, or chargebacks initiated with your financial institution.


6. Content & Intellectual Property

6.1 All content on Popapp, including logos, text, graphics, images, videos, and software, is owned by Popapp or its licensors.
6.2 You may not copy, reproduce, distribute, or create derivative works without Popapp’s written permission.
6.3 You may post user-generated content (reviews, comments, photos) but grant Popapp a worldwide, royalty-free license to use, display, and share your content.


7. Privacy

7.1 Your use of Popapp is subject to our Privacy Policy, which explains how we collect, use, and store your personal information.
7.2 By using the Service, you consent to the collection and processing of your data in accordance with the Privacy Policy and South African Protection of Personal Information Act (POPIA).


8. Disclaimers

8.1 Popapp provides the Service “as is” and “as available”.
8.2 Popapp does not guarantee the accuracy, completeness, or availability of event information.
8.3 Popapp is not responsible for any loss, injury, or damages arising from your use of the Service, including attendance at events.


9. Limitation of Liability

9.1 To the fullest extent permitted by law, Popapp and its affiliates, directors, employees, and agents are not liable for any indirect, incidental, special, or consequential damages.
9.2 Our total liability for claims related to the Service will not exceed the amount you paid, if any, to Popapp in the 6 months preceding the claim.


10. Termination

10.1 Popapp may suspend or terminate your access at any time for violation of these Terms.
10.2 Sections 4–9 survive termination.


11. Governing Law & Dispute Resolution

11.1 These Terms are governed by the laws of South Africa.
11.2 Any dispute arising from these Terms will be resolved in the courts of South Africa, unless otherwise agreed in writing.


12. Changes to Terms

12.1 Popapp may update these Terms from time to time.
12.2 Changes will be effective immediately upon posting.
12.3 Continued use of the Service after changes constitutes acceptance of the new Terms.
